VW Faces Calls to Buy Back Diesel Vehicles
In a novel legal strategy, two law firms are seeking to force Volkswagen (VW) to buy back diesel vehicles that contain emissions cheating software. Quinn Emanuel Urquhart & Sullivan LLP filed a motion under an existing class action, seeking to force the auto manufacturer to buy back diesel vehicles under common law claims and consumer protection statues. Hagens Berman Sobol Shapiro LLP’s motion seeks to create a California-specific class, and holds that California’s required emissions warranties should trigger the return of affected vehicles in exchange for replacement or restitution.
While these motions may not succeed, they will further pressure VW to take action to correct the growing scandal due to the use of emissions cheating software. I can only hope that VW will act swiftly to restore the faith of consumers.
